Land remediation in DEKRA

 

The process of land remediation is complicated and, as such, requires constant, professional control of its course. An experienced DEKRA supervisor supervises the entire process to ensure that the property owner carries out land remediation, as required by law.

 

What is land remediation?

 

The remediation process consists in subjecting the soil, earth and groundwater to measures aimed at removing or reducing the number of substances which can render the said soil, earth and groundwater hazardous.

 

Land remediation also involves controlling harmful compounds and limiting their spread. The self-cleaning of soil, if it brings the greatest environmental benefits, can also be considered as the remediation of soils.

 

The purpose of the remediation process is to achieve a state in which the contaminated area is no longer a threat to human health or to the environment.

 

 

The concept of remediation was introduced into Polish law in the amendment to the legislation, ‘The Act on Environmental Protection’ of September 5, 2014.

 

 

 Who is obliged to carry out land remediation?

 

 According to Polish law, the obligation to carry out land remediation rests with:

  • the property owner or
  • with another entity administering the plot of land

 where there is historical ground pollution, that is, ground pollution occurring prior to April 30, 2007, or is the result of activities completed before April 30, 2007.

In the legislation on Environmental Protection, there are exceptions, according to which remediation is carried out by another polluter or by the Regional Director of Environmental Protection.

 

 

The need for remediation applies especially to buyers of real estate. The regulations do not provide for the possibility of exemption for landowners with responsibility for historical pollution, which means that any future owner of a building plot must bear remediation costs.

The remediation plan determines:

 

  • an area requiring remediation, along with an indication of the address and numbers of parcels with their area
  • the names of the substances and their content which pose a risk to the soil and earth and to which remediation will be directed
  • the method to be adopted in the remediation to be carried out
  • start and end of the remediation process
  • the method to be adopted for confirmation of the remediation and the deadline for submitting documentation on its implementation, including the results of tests on the contamination of soil and earth
